Terms and Conditions Kundalini Yoga Festival Nederland 2019
1.1 These terms and conditions apply to every agreement that is established in the context of a visit to the Kundalini Yoga Festival Nederland (hereinafter referred to as: the “event”) and the purchase of any admission tickets for that purpose between the visitor (hereinafter referred to as: the “customer”) and the Kundalini Yoga Festival Nederland Foundation (hereinafter referred to as: the “organization”), regardless of how the agreement was established. The visitor agrees to comply with the contents of these terms and conditions by purchase and/or use of an admission ticket and/or entering the location where the event is held (hereinafter referred to as: the “event location”).
1.2 The event location may put her own house rules in effect that will apply in addition to these terms and conditions, which can be found on the website of the organization of the event (www.kundaliniyogafestival.nl) and/or at the event location. By purchasing an admission ticket, the visitor agrees to comply with these additional house rules.
1.3 The organization reserves the right to change these terms and conditions completely or partially at any time. Visitors will be informed of such changes in a timely manner through a report on the website of the organization.
Tickets and Admission
2.1 The agreement between the organization and the visitor for the purchase of tickets is established when the visitor places an order for one or more tickets on the website www.kundaliniyogafestival.nl. One or more admission tickets will be reserved for the customer upon payment.
2.2 Any information regarding the event and/or the admission tickets, such as announcements and prices, will be provided as accurately as possible. The organization can not be held responsible when she has not correctly or completely delivered such information to the customer.
2.3 Admission tickets will be provided to the visitor once, and they grant the holder of the ticket a single entry to the event and the event location. Admission tickets are and remain property of the organization and are provided to the buyer.
2.4 The validity of the admission ticket is only guaranteed when it was purchased on www.kundaliniyogafestival.nl. The burden of proof in that regard lies with the customer. The admission tickets will only be provided once by e-mail and must be presented upon entry to the event.
2.5 The admission tickets are personalised and may not be resold or provided to a third party. The organization reserves the right to refuse access to any person without a valid admission ticket. Only the holder of the admission ticket who presented the admission ticket first at the start of the event will be admitted to the event.
2.6 The organization will assume that the holder of the admission ticket is also the rightful claimant (the customer) of that admission ticket. The customer is responsible for ensuring that he is and remains the holder of any admission tickets purchased through the ticketing system of the event.
2.7 The organization can not be held responsible for any loss of and/or damage to admission tickets, whatever the cause may be.
2.8 Upon entry to the event, a wristband will be given to the customer only when the customer able to present a valid admission ticket and a valid proof of identity. The customer must wear this wristband on their wrist for the entire duration of the event, and it may in no event be removed or given to a third party. The customer must be able to present the wristband at all times upon the first request of the staff of event and/or any other authorized persons.
2.9 In the event of force majeure or any type of impediment, including but not limited to illness and/or cancellation of the artists, strike, fire, poor weather conditions and epidemics, the organization reserves the right to postpone and/or cancel the event.
2.10 If the event is cancelled by the organization as a result of or in connection with force majeure, the organization will only be obliged to refund to the customer the price stated on the admission ticket, regardless of the price the customer has paid for the admission ticket. Refunds will provided to the customer by the ticket provider within twelve weeks of the cancellation date. Service costs and other damages will not be reimbursed. Neither can the customer claim (replacement) access to another event.
2.11 Reservations of admission tickets may be cancelled by the customer. The cancellation fee is 45 euros. In addition, 15% of the ticket price will be withheld when the admission ticket is cancelled before October 19th, 2019. 30% of the ticket price will be withheld when the admission ticket is cancelled on or after October 19th but before November 19th, 2019. 50% of the ticket price will be withheld when the admission ticket is cancelled on or after November 19th, 2019.
3.1 The admission ticket states in what kind of room the customer will spend the nights, and the customer will adhere to this.
3.2 Starting at 10 p.m. each day, each customer is expected to be quiet and limit the lighting of rooms to what is necessary.
4.1 The customer must adhere to the (house) rules of the event and instructions from staff and any other authorized persons. The organization reserves the right to deny and/or revoke access to the event and/or the event location if it is deemed reasonably necessary to maintain peace and order during the event, or in the event of non-compliance with the (house) rules.
4.2 The organization reserves the right to frisk the customer at any time. To enable the organization to meet its legal obligations, visitors must be able to identify themselves upon request.
4.3 It is not permitted to bring alcohol, drugs, fireworks, firearms, weapons, dangerous objects or professional photo, film or other recording equipment to the event. Whether the equipment is professional is solely judged by the organization. The organization will confiscate all banned items at the entrance (or have them confiscated). All legally owned valuables can be collected later.
4.4 It is prohibited to film or photograph the event for commercial and/or publication purposes without explicit consent from the board of the organization.
4.5 The customer enters the event location and attends the event at their own risk. The organization can not be held responsible for loss of, theft of and/or damage to visitors’ possessions, any consequential damages or immaterial damage.
4.6 The organization can not be held responsible for damaged hearing, reduced vision, or any other physical injury that may be directly or indirectly result from visiting the event.
4.7 The organization will endeavour to ensure that the program is implemented in accordance with the announced timetable as much as possible. However, the organization can not be held responsible for deviations therein, or for any resulting damages to the customer and/or third parties. All starting times stated on admission tickets are subject to change. It is the responsibility of the customer to regularly check (www.kundaliniyogafestival.nl) for any deviations in starting times. The customer must keep track of times and changes via the website.
4.8 The organization can not be held responsible for the duration or cancellation of parts of the event program.
4.9 Smoking is not permitted inside any of the buildings. Any fines imposed on the organization as a result of violations of this rule by the customer will be recovered from the customer.
4.10 It is not permitted to bring pets or animals to the event. Furthermore, it is not permitted to perform commercial activities on the event location without the explicit permission from the board of the organization, nor is it permitted to express oneself in any way that is repulsive, discriminatory or offensive, or to bear or spread signs or symbols of such nature.
5.1 The organization processes the personal data of customers and visitors to its website in accordance with the General Data Protection Regulation (EU)2016/679 (Dutch: Algemene verordening gegevensbescherming).
5.2 It is possible that photo, video and/or audio recordings will be made of the event and the customer, and that these recordings will be made public or reproduced. The customer gives unconditional consent to make the aforementioned recordings and exploitation thereof without the organization or third parties owing a fee to the visitor. Any related rights and/or copyrights and/or portrait rights are transferred by the customer to the organization without restrictions. Furthermore, the customer irrevocably waives the right to invoke its personality rights.
If the customer considers this undesirable, the customer must make this known to the organization of the event in advance. The organization will then provide the customer with a sticker which must be visibly worn by the customer.
6.1 Dutch law applies to these terms and conditions.
6.2 Any disputes, of any nature whatsoever, that arise between the customer and the organization as a result (through the use or application) of these terms and conditions and/or related agreements, will be submitted exclusively to the applicable court of law.
